Terms of Service

These Terms of Service ("Terms") are a contract between you and Skylab Studio LLC ("we", "us"), operator of EyesOnDeck (the "Service"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.

You must be at least 18 years old and legally able to enter into contracts to use the Service. Tester accounts require manual approval; we may refuse or revoke approval at our discretion.

• You are responsible for anything that happens under your account.
• Provide accurate information and keep it up to date.
• Don't share your login. Notify us of any unauthorized use.

If you use the Service as a company hiring testers, you agree that:

• You will only submit campaigns for products you have the right to test.
• You will not ask testers to perform illegal, harmful, deceptive, or explicit activities.
• You will pay for campaigns you launch per the pricing shown at checkout.
• Feedback submitted by testers is licensed to you for use in improving your product; testers retain moral rights where applicable.

If you use the Service as a tester, you agree that:

• You are an independent contractor, not our employee.
• You will provide honest, first-hand feedback and will not submit AI-generated or fabricated responses.
• You will keep confidential any pre-release product info you see during a test.
• You are responsible for your own taxes on any payouts you receive. See the Tester Agreement for the full terms.

You may not:

• Reverse-engineer, scrape, or overload the Service.
• Use the Service to harass, defraud, or infringe others' rights.
• Submit malware or attempt to access data you're not entitled to.
• Create multiple accounts to game the marketplace.

Pricing is shown on the Pricing page. Fees are non-refundable except as required by law or expressly stated. Payment processing may be handled by third-party providers, and their terms will apply in addition to ours.

We own the Service, our brand, and the software behind it. You keep ownership of the content you submit, but you grant us a worldwide, non-exclusive, royalty-free license to host, process, and deliver it as needed to operate the Service.

You can close your account any time. We can suspend or terminate accounts that violate these Terms or that we reasonably believe pose a legal, security, or fraud risk.

The Service is provided "as is" without warranties of any kind. We don't guarantee that testers will produce any specific outcome or that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, Skylab Studio LLC will not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months before the claim (or USD $100, whichever is greater).

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Delaware, unless applicable consumer law gives you another forum.

We may update these Terms. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use after that means you accept the new Terms.
